Terms & Conditions
These Terms & Conditions apply to all quotes, proposals, and invoices issued by KG_Codes, a subsidiary of K & B Group Holdings, LLC (“Developer”) to the receiving party (“Client”). By approving or submitting payment toward a quote, Client agrees to the following:
1. Scope of Work
All deliverables, services, and included revision rounds are defined in the attached quote. Any additional features, pages, or functional requests outside the defined scope will be treated as a Change Order and billed at the hourly rate listed in the quote.
2. Client Content Requirement
Client is responsible for providing all written content, images, branding assets, and other required materials unless stated otherwise in the quote. Delays in content delivery may delay the project timeline.
3. Payment Terms
For projects greater than $1,000:
- 50% non-refundable deposit due at approval
- Remaining balance due prior to launch or delivery
For projects $1,000 or less:
- 100% payment upfront
Late payments may incur a 5% monthly fee.
4. Revisions
Unless stated otherwise:
- Up to 2 revisions per milestone are included
- Additional revisions or redesign requests are billed at $95/hour (standard) or $125/hour for rush/after-hours work
- Approval of a milestone locks that work as complete
5. Timeline & Rush Work
Estimated timelines assume timely Client responses and content submission. Delays caused by Client may shift deadlines.
Rush scheduling:
- Under 3 weeks → +30% surcharge
- Under 10 days → +50% surcharge
Rush availability is not guaranteed.
6. Launch & Support
Launch includes connection to Client’s domain and basic testing. Client receives 14 days of complimentary support for bug fixes related to the original scope.
After the 14-day period:
- Support and updates are billed at $95/hour
- Optional support plans may be offered separately
7. Ownership
- Client owns the final published website content and completed deliverables after full payment is received.
- Developer retains ownership of reusable development assets, code frameworks, and proprietary tools.
- Developer retains portfolio/display rights by default, unless Client requests removal in writing.
8. Hosting & Domains
- Domain registration, email services, and third-party subscription costs are Client’s responsibility, unless explicitly included.
- If Client elects not to retain Developer for ongoing support, Client assumes full responsibility for hosting administration after launch.
9. Communication & Availability
Client acknowledges that communication and development work primarily occur outside standard business hours. Weekend or off-hours requests may be billed as rush.
10. Cancellations
If Client cancels work after approval:
- Deposit remains non-refundable
- All completed work will be billed immediately and delivered once paid
Developer may pause or terminate work for non-payment or lack of response.
11. Legal
This agreement and all related services are governed by the laws of Volusia County, Florida, and disputes are subject to jurisdiction in that venue.
By approving a quote from KG Codes, Client agrees to these Terms & Conditions.
